If you do not agree with any part of these Terms, please discontinue use of the website and our services.

3. Eligibility

You must be legally capable of entering into a binding agreement to purchase or use our paid services.

If you are using our services on behalf of a company, organization, or other business entity, you represent that you have the authority to accept these Terms on behalf of that entity.

4. Our Services

We aim to provide professional digital marketing services based on the information, requirements, goals, and materials provided by each client.

The exact scope of work may be communicated through email, proposals, invoices, messages, contracts, calls, or other written communication.

Any service or deliverable not specifically included in the agreed scope of work may require additional charges.

5. 7-Day Free Trial

Work With Nandini may offer eligible prospective clients a 7-Day Free Trial for selected services.

The purpose of the free trial is to allow prospective clients to experience our working approach and determine whether our services are suitable for their business.

The exact services, activities, deliverables, and limitations included in the free trial may depend on the client’s business and requirements.

The free trial does not guarantee specific leads, sales, revenue, rankings, advertising results, or other business outcomes.

We reserve the right to determine eligibility for the free trial and to modify, suspend, or discontinue the free-trial offer where reasonably necessary.

Unless expressly agreed otherwise, continuation of services after the trial period may require a paid service agreement.

6. Client Responsibilities

To provide our services effectively, clients may be required to provide accurate and timely information, including:

  • Business information

  • Product or service details

  • Branding materials

  • Website access

  • Advertising account access

  • Analytics information

  • Images and videos

  • Email marketing platform access

  • Content and copy

  • Required approvals

  • Other information reasonably necessary to perform the agreed services

Clients are responsible for ensuring that the information and materials they provide are accurate, lawful, and that they have the necessary rights or permissions to use them.

Delays in providing information, access, feedback, or approvals may result in delays to the project.

7. Payments and Fees

Fees for paid services will be communicated before the commencement of the relevant paid work.

Unless otherwise agreed in writing, clients must make payments according to the payment schedule stated in their proposal, invoice, agreement, or other written communication.

Additional work outside the originally agreed scope may be charged separately.

Any advertising spend paid directly to advertising platforms or other third-party expenses is separate from our professional service fees unless specifically stated otherwise.

8. Advertising Budgets

For services involving paid advertising, including Meta Ads and Google Ads, the advertising budget is generally separate from our service or management fees unless expressly agreed otherwise.

Advertising spend may be paid directly by the client to the relevant advertising platform.

Work With Nandini is not responsible for charges independently imposed by third-party advertising platforms.

9. No Guarantee of Results

Digital marketing results depend on numerous factors outside our direct control, including:

  • Market conditions

  • Competition

  • Advertising budget

  • Audience behaviour

  • Product or service demand

  • Website performance

  • Pricing

  • Client responsiveness

  • Platform algorithms

  • Search-engine updates

  • Advertising-platform policies

  • Business reputation

  • Offer quality

While we use reasonable professional efforts and marketing strategies, Work With Nandini does not guarantee any specific number of leads, sales, customers, revenue, return on investment, search-engine rankings, followers, engagement, or other specific results.

Past performance or examples should not be interpreted as a guarantee of future results.

10. Meta Ads and Google Ads

Advertising platforms have their own rules, policies, algorithms, approval systems, and account-management procedures.

Advertisements may be rejected, restricted, suspended, delayed, or otherwise affected by decisions made by third-party platforms.

Work With Nandini cannot guarantee advertisement approval or continuous availability of any third-party advertising account or platform.

11. Search Engine Optimization

SEO is a long-term marketing process.

Search-engine rankings can change due to competition, algorithm updates, website changes, technical factors, and other circumstances outside our control.

Therefore, we do not guarantee specific Google rankings, positions, traffic volumes, or timelines.

12. Third-Party Platforms and Services

Our services may involve third-party platforms or tools, including search engines, social-media platforms, advertising platforms, email-marketing platforms, website software, analytics tools, hosting providers, plugins, and other services.

These third-party services operate independently and are subject to their own terms, policies, pricing, and availability.

Work With Nandini is not responsible for outages, policy changes, suspensions, technical failures, pricing changes, or other actions taken by third-party providers.

13. Intellectual Property

Unless otherwise stated, the content available on the Work With Nandini website, including text, graphics, branding, website design elements, marketing materials, and original content, belongs to Work With Nandini or is used with appropriate permission.

You may not copy, reproduce, republish, distribute, sell, modify, or commercially exploit our website content without prior written permission.

Client-specific intellectual-property ownership for completed paid projects may be determined by the applicable proposal, agreement, invoice, or written arrangement.

14. Client Materials

Clients retain responsibility for materials they provide to us.

By providing logos, photographs, videos, text, trademarks, customer information, or other materials, the client confirms that they have the necessary rights and permissions for those materials to be used for the requested services.

The client agrees not to provide material that violates applicable law or infringes another person’s intellectual-property or other legal rights.

We make reasonable efforts to keep our website accessible and functioning properly.

However, we do not guarantee uninterrupted or error-free availability.

  • To distribute malicious software or harmful code

  • To attempt unauthorized access to our website or systems

  • To interfere with the operation or security of the website

  • To misuse our content or intellectual property

  • To submit false, misleading, or fraudulent information

  • In any manner that violates applicable laws or regulations

We reserve the right to restrict access to our website or services in cases of misuse.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Work With Nandini will not be liable for indirect, incidental, special, consequential, or business losses arising from the use of our website or services.

This may include loss of profits, revenue, business opportunities, data, advertising spend, or anticipated savings where such losses arise from circumstances outside our reasonable control.

Nothing in these Terms is intended to exclude or restrict liability that cannot legally be excluded or restricted under applicable law.

19. Cancellations and Refunds

Cancellation and refund eligibility for paid services may depend on the specific service, project stage, work already completed, third-party costs incurred, and any written agreement made with the client.

Any service-specific cancellation or refund terms communicated through a proposal, invoice, contract, or written agreement will apply to that engagement.

Where work has already been completed or third-party expenses have already been incurred, those amounts may be non-refundable to the extent permitted by applicable law.

Nothing in this section is intended to limit any mandatory rights available to consumers under applicable law.

20. Privacy

Your use of our website and services may involve the collection and processing of personal information.

Please review our Privacy Policy for information about how personal data is collected, used, stored, and protected.

22. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, business practices, website, or applicable requirements.

When changes are made, the updated version may be posted on this page with a revised “Last Updated” date.

Continued use of the website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

23. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the applicable laws of India.

Any dispute arising from these Terms, the website, or our services will be handled in accordance with applicable Indian law and subject to the jurisdiction of the competent courts, unless applicable law requires otherwise.

24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to remain in effect to the fullest extent permitted by law.

25. Entire Agreement

These Terms, together with any applicable service proposal, invoice, written agreement, Privacy Policy, and other policies referenced herein, constitute the agreement governing your use of our website and applicable services.

Where a separate written client agreement contains terms that conflict with these general website Terms, the specific written client agreement will generally govern that particular engagement.
